I'm not sure what you mean by "proven criminals." The inmates at Guantanamo are claimed to have been enemy combatants rather than criminals, and thus the criminal justice procedures to which you refer would never have applied to them.
It's rather a simple point of law -- I'd be almost surprised at you for not understanding this after 7 1/2 years of warfare, except that I know that it's a common pose on the Left.
